Privacy notice

This notice covers careguard.ai and the information CareGuard receives through it. CareGuard is a Patient Safety Organization listed by AHRQ (PSO P0268), operated by Sevadar Foundation Inc. It is not a health care provider and delivers no treatment.
Reports submitted through the reporting channel
This is the most important section on the page, so it is first.
- CareGuard does not retain a copy of an incident report. Reports submitted through the CareGuard Reporting System are transmitted to the facility’s designated legal counsel and to facility ownership. CareGuard acts as a facilitator of that transmission and does not store, archive or maintain the reports.
- A name is optional. If you provide one, it travels with the report to those recipients. If you do not, the report is transmitted without it.
- Once a report reaches the facility and its counsel, their handling governs. CareGuard has no control over what a facility or its attorneys do with a report and cannot retrieve, amend or delete it on your behalf.
- The form is operated on JotForm. Submissions pass through that service, which processes them on CareGuard’s behalf under its own terms.
- Please do not include a resident’s full name or identifying health information if the situation can be described without it. A web form is not a secure medical channel.

Patient safety work product
CareGuard is a listed Patient Safety Organization. Information that a provider develops within its patient safety evaluation system for reporting to a PSO may qualify as patient safety work product under the Patient Safety and Quality Improvement Act of 2005 and the Patient Safety Rule at 42 C.F.R. Part 3, which carries federal confidentiality and privilege protections and its own defined exceptions. Where CareGuard receives patient safety work product under a Patient Safety Act contract with a provider, it is handled under that Act, that Rule and the contract — not under this website notice. What this website collects
- What you type into the contact form: name, email, phone number and message. Nothing else is requested and no address field exists.
- Ordinary server logs: IP address, user agent, requested URL and timestamp, kept for security and troubleshooting.
- Cookies: the site sets no advertising or cross-site tracking cookies. WordPress may set functional cookies for logged-in administrators.
- Video: embedded videos are not loaded until you click the play control. Nothing is requested from YouTube on page load, and when you do click, the embed uses youtube-nocookie.com.
What CareGuard does with it
- Answers you.
- Keeps the site working and secure.
- Nothing else. CareGuard does not sell personal information, does not rent it, and does not share it with advertisers or data brokers.
Service providers
The site is hosted by a commercial web host, and the reporting and review-request forms are operated on JotForm. Each processes data on CareGuard’s behalf in order to provide its service.
Retention
Contact-form messages are kept as long as needed to deal with the matter and for ordinary business records. Server logs are kept on a short rolling window. Incident reports are not retained at all — see the first section.
Your choices
You can ask what CareGuard holds about you, ask for it to be corrected, or ask for it to be deleted, by writing to seva@padda.com or to CareGuard, 4477 Woodson Rd, Suite 203, St. Louis, MO 63134. Two limits apply and are stated rather than buried: CareGuard cannot act on an incident report it never kept, and it cannot delete material it is required to preserve.
Children
This site is directed at facility owners, operators, staff and families of adult residents. CareGuard does not knowingly collect information from children.
Changes
If this notice changes, the date at the top changes with it.
